GR Firm is proud to announce that today the Honorable Judge Mark A. Kearney from the US District Court for the Eastern District of Pennsylvania entered a Final Order and Judgment approving the parties’ Nationwide Class Action Settlement on behalf of over 100,000 distressed borrowers under the CARES Act forbearance.
The lawsuit alleged that Shellpoint violated the Fair Debt Collection Practices Act (“FDCPA”) by sending misleading mortgage statements to borrowers under the CARES Act: threatening to foreclose on their homes for past due amounts despite their active forbearance plans.
Although Shellpoint denied liability as part of the settlement, it nonetheless agreed to pay the full $500,000 statutory damages under the FDCPA, plus an additional $250,000 in attorneys’ fees to resolve the lawsuit on a class-wide basis. As a result, Class members will receive immediate economic relief as well as corporate reform measures from Shellpoint.
In its Final Approval Order, Judge Kearney commended GR Firm’s and its co-counsel Bailey & Glasser’s performance in successfully litigating the lawsuit on behalf of the Class:
